Gov. Hochul activates HERO Act. Workplace safety rules required.
From the Lake George Chamber of Commerce: Gov. Kathy Hochul announced that the commissioner of health has designated COVID-19 a highly contagious communicable disease that presents a serious risk of harm to the public health under New York State's HERO Act, which requires all employers to implement workplace safety plans in the event of an airborne infectious disease.
The NY HERO Act mandates extensive new workplace health and safety protections in response to the COVID-19 pandemic. Under the law, all employers are required to adopt a workplace safety plan and implement it for all airborne infectious diseases designated by the New York State Department of Health. Employers can adopt a model safety plan as crafted by the New York State Department of Labor or develop their own safety plan in compliance with HERO Act standards.
The Steps to HERO Act Compliance:
New York State Department of Labor (NYS DOL) and Department of Health (DOH) developed a new Airborne Infectious Disease Exposure Prevention Standard, a Model Airborne Infectious Disease Exposure Prevention Plan, and various (private) industry-specific model plans for the prevention of airborne infectious disease.
Some dates to note are:
- Sept. 4 – Employee Communication due
- Nov. 1 – Workplace Safety Committees due
For those members who already have Safety Committees, that group WILL fulfill this requirement.
- Employers can choose to adopt the applicable policy template/plan provided by NYS DOL or establish an alternative plan that meets or exceeds the standard’s minimum requirements. [Click here for the pdf of the plan.]
- This only applies to airborne infectious agents or diseases designated by DOH as a highly contagious communicable disease that presents a serious risk of harm to the public health.
- Each employer must establish a written exposure prevention plan designed to eliminate or minimize employee exposure to airborne infectious agents in the event of an outbreak of an airborne infectious disease.
- Employers must select and obtain appropriate exposure controls based on the types and level of exposure risks employees have during all activities performed at the worksite.
